چیف جسٹس اور نیاز اللہ نیازی میں پھر تلخی
سپریم کورٹ میں الیکشن ٹربیونلز کی تشکیل کیخلاف کیس کی سماعت کے آغاز میں ہی چیف جسٹس اور تحریک انصاف کے وکیل نیاز اللہ نیازی کے درمیان تلخی ہوگئی۔
تحریک انصاف کے وکیل نیاز اللہ نیازی نے بنچ میں چیف جسٹس کی شمولیت پر اعتراض کیا جسے چیف جسٹس نے مسترد کردیا۔
چیف جسٹس نے ریمارکس دیے کہ کیوں نہ نیاز اللہ نیازی کیخلاف کیس پاکستان بار کونسل کو بھجوادیں. کیا ہم اپنی بے عزتی کیلئے یہاں بیٹھے ہیں. بس اب بہت ہوگیا ہمیں معلوم ہے آپ کی ایک سیاسی جماعت سے وابستگی ہے. مسلسل عدلیہ کی تضحیک کی اجازت نہیں دیں گے. عدلیہ کی تضحیک کا سلسلہ بند کریں۔
چیف جسٹس نے یہ بھی کہا کہ اب چیف جسٹس کا بنچ بنانے کا دور ختم ہوگیا. اب بنچ بنانے کا اختیار پریکسٹس اینڈ پروسیجر کمیٹی کو ہے۔
نیاز اللہ نیازی نے عمران خان کے بارے میں اشارتا کہا کہ جو قید میں ہے اس کا اعتراض ہے کہ انتخابی نشان چھینا گیا۔
چیف جسٹس نے کہا کہ ہم نے جیل سے ویڈیو لنک کی سہولت دی اعتراض اس وقت بھی نہیں اٹھایا گیا. انٹراپارٹی الیکشن کیس میں علی ظفر نے کوئی اعتراض نہیں اٹھایا. اداروں کو بدنام کرنے کا سلسلہ بند ہونا چاہیے. اخباروں میں سرخی لگادی جاتی ہے کہ بنچ کیسے بن گیا. پاپولر فیصلوں کا دور گزر چکا ہے. اب بنچ بنانے کا اختیار کمیٹی کے پاس ہے۔
جسٹس جمال خان مندوخیل نے بھی کہا کہ لوگوں کی خواہشوں پر عدالتیں نہیں چلتیں۔ یاد رہے کہ اس سے پہلے بھی چیف جسٹس اور پی ٹی آئی وکیل نیاز اللہ نیازی میں ایک کیس کی سماعت کے دوران تلخ کلامی ہوگئی تھی. اور پی ٹی آئی وکیل نے چیف جسٹس پر بھری عدالت میں سنگین الزام لگایا تھا۔

Chief Justice and Niazullah Niazi Clash Again. During the hearing of the case against the formation of election tribunals in the Supreme Court a heated exchange occurred between the Chief Justice and PTI lawyer Niazullah Niazi right at the outset.
Niazullah Niazi objected to the inclusion of the Chief Justice in the bench. Which the Chief Justice dismissed.
The Chief Justice remarked, “Why not refer the case against Niazullah Niazi to the Pakistan Bar Council? Are we here to be insulted? This has gone too far. We know of your affiliation with a political party. We will not allow continuous contempt of the judiciary. Stop the disrespect towards the judiciary.”
The Chief Justice also stated that the era of the Chief Justice forming the bench has ended. Now the authority to form benches lies with the Practice and Procedure Committee.
Niazullah Niazi referring to Imran Khan indirectly said that the one in prison objects to having his electoral symbol taken away.
The Chief Justice responded, “We provided video link facilities from jail. No objection was raised at that time. In the intra-party election case Ali Zafar raised no objection. The campaign to discredit institutions must stop. Headlines in newspapers claim how the bench was formed. The era of popular decisions has passed. Now the authority to form benches is with the committee.
Justice Jamal Khan Mandokhail added that the courts do not run on people’s wishes. It is worth noting that previously during another case hearing there was also a heated exchange between the Chief Justice and PTI lawyer Niazullah Niazi during which the PTI lawyer leveled serious accusations against the Chief Justice in open court.
